Announcement Re Local Rule Changes Effective December 1, 2016

District Court Local Rules Amendments

Effective December 1, 2016

        This notice provides important information about amendments to the Local Rules for the United States District Court for the District of Maine that become effective December 1, 2016.

Local Rule 7 – Motions and Memoranda of Law

Subsection (f) regarding written submissions and oral argument is amended to reflect that unless otherwise required by federal rule or statute, all motions may be decided by the Court without oral argument unless otherwise ordered by the Court on its own motion or, in its discretion, upon request of counsel.

Local Rule 16.2 – Scheduling Order

Subsection (e) governing objections is revised to provide that a party wishing to alter any deadline or discovery limitation in a scheduling order must file a detailed explanation of the reasons for each requested alteration with the objection, or request a scheduling conference with a judicial officer, or both.

Local Rule 54.3 – Bill of Costs

This rule is amended to reflect that Bills of Costs should be submitted to the Court using the forms available from the Clerk’s Office except in those situations when a party is applying for costs as part of an application for statutorily permitted attorneys’ fees pursuant to Local Rule 54.2.

Local Rule 83.1 – Attorneys – Admission

Subsection (c)(1) which governs attorneys who are not members of the bar of this Court is amended to make clear that local counsel’s attendance at any proceeding before a judicial officer is required unless excused by the Court, which should freely grant such leave upon request.

Local Rule 67 – Deposit of Registry Funds in Interest Bearing Accounts

This rule is amended to (1) require that interpleader funds deposited with the Court under 28 U.S.C. § 1335 must be deposited in the CRIS Disputed Ownership Fund, and (2) comply with the District Court Miscellaneous Fee Schedule effective December 1, 2016, which sets the fees for management of registry funds and disputed ownership funds.
